Allgemeine Geschäftsbedingungen AGB (for English please scroll down)
KundInnen von Abroadcom (registriert 33a Bartholomew St, Brockville, Ontario, Kanada) stimmen mit dem Abonnement der podcasts folgenden Geschäftsbedingungen zu:
1. Das Abonnement von Abroadcom podcasts berechtigt zum privaten Gebrauch. Vorführung, teilweise Verwendung oder Abspielung von Abroadcom podcasts in der Öffentlichkeit, zu Ausbildungszwecken oder auf Radiosendern und im Internet ist möglich, jedoch nicht ohne vorherige, SCHRIFTLICHE, zusätzliche Abmachungen mit Abroadcom zu treffen.
2. Das Abonnement von Abroadcom podcasts ist exklusiv. Urheberrechte bleiben bei den UrheberInnen der kompilierten Songs. Ein Abonnement erlaubt es dem/der KundIn, den podcast auf ein Computer/Laptop herunterzuladen. Weiterhin ist es legal, diesen podcast auf einen tragbaren Datenträger (iPod oder vergleichbar) zu kopieren. Zusätzliche Kopien können nur zum Zweck der Datensicherung angefertigt werden. Widerechtliche Vervielfältigung und Verbreitung der podcasts unterliegt STRAFRECHTLICHER VERFOLGUNG IN DEUTSCHLAND UND KANADA!
3. Abroadcom verpflichtet sich, jeden Monat einen podcast in Form von zwei Audiodateien von je 25-30 Minuten Länge, ca. 50 Mb Größe dem/der KundIn zum Download zur Verfügung zu stellen. Sollte wegen Krankheit oder höherer Gewalt eine oder mehrere Folgen dieses Stadium nicht erreichen, verlängert sich das Abonnement automatisch für die Dauer der versäumten podcasts. Dies ist bisher (seit November 2008) nicht vorgekommen.
4. Der Transfer der podcasts erfolgt von Abroadcom’s Computerserver per rechtem Mausklick auf die betroffene Datei auf die Computer-Festplatte der/des KundIn. Dieser Vorgang erfordert keinerlei zusätzlichen Computerapplikationen, kann jedoch einige Zeit dauern, da die Dateien aufgrund ihrer sendefähigen Tonqualität (256 kBit stereo) relativ groß sind. Die vorherige Bezahlung per Paypal (alle populären Kreditkarten) ist dafür erforderlich. Dateien per Dial-Up herunterzuladen ist nicht empfehlenswert für Internet-BenutzerInnen. Ob die Dateien korrekt und abspielbar auf der Festplatte des Computers der/des KundIn ankommen, ist nicht Abroadcom’s Verantwortung und keinerlei Ansprüche aufgrund unvollständiger Dateitransfers können gegenüber Abroadcom geltend gemacht werden.
5. Schäden, die dem/der KundIn nachweisbar oder dem Anschein nach durch das Herunterladen oder Abspielen von Abroadcom’s podcasts entstehen, können nicht gegenüber Abroadcom geltend gemacht werden. Es ist sehr empfehlenswert, ein Anti-Virus-Programm auf dem KundInnen-Computer installiert zu haben, um Computerschäden im Zusammenhang mit Datenübertragungen zu vermeiden.
6. Der/die Kundin kann das Abonnement jederzeit ohne jeglichen Ersatz und/oder Vergütung seitens Abroadcom kündigen.
General Operating Rules and Regulations / Fineprint
Customers of Abroadcom (registered 33a Bartholomew St, Brockville, ON, Canada) agree with their subscription to the podcasts with the following Operating Rules and Regulations:
1. Subscription to Abroadcom podcasts allows for private, non-commercial use. Presentation and/or partial use in public, for educational purposes or by radio stations is possible, however not without prior, additional agreements IN WRITTEN FORM with Abroadcom.
2. The subscription to Abroadcom podcasts is exclusive. Copyright remains with original copyright holders of the compiled songs. One (1) subscription allows one (1) customer to download the podcast on one (1) computer/laptop. Furthermore it is legal to copy that downloaded podcast-file onto one (1) mobile device such as iPod or the like. Additional copies can only be made for data backup purposes. Illegal copying and distribution of Abroadcom podcasts is subject to prosecution in Germany and Canada.
3. Abroadcom assures to make available to the customer one (1) podcast every month in form of two (2) audio files of each 25-30 minutes length, approximately 50 Mb in size for download. In case one or more editions do not reach this stadium due to illness or higher force, the subscription is automatically extended by the amount of missed podcasts. This has never occurred since the beginning of operations in November 2008.
4. The podcasts are transferred from Abroadcom’s online server via mouse right click on to the customer’s hard drive. This process does not require any additional software but may take some time because the podcasts’ radio-quality generates relatively big files (256kBit stereo). To access the download, the customer pays beforehand via Paypal (all major credit cards). It is not recommended to download the files using Dial-Up service. Whether or not the downloaded files reach the customer’s hard drive as desired does not fall within Abroadcom’s responsibilities, and no claims can be held against Abroadcom based on incomplete data transfers.
5. Damages, which were proven or seen to have been caused by downloading or playing of Abroadcom podcasts, cannot be claimed of Abroadcom. It is urgently recommended to install an anti-virus-program to avoid computer damages in conjunction with data transfers.
6. The customer can terminate the subscription at any time without any previous note to, or any replacement or recompensation by Abroadcom.
7. Please be advised that Abroadcom is not in the position to process any refunds after you subscribe. Choose your individual subscription carefully. Thank you and enjoy!
